The North Liberty City Council met in regular session in Council Chambers.  Mayor Mekota called the meeting to order at 7:00 p.m.

Council members present:  Bahl, Gardiner, Moody, Salm and Soukup.

Also present were Brian James, William J. Sueppel, Kevin Trom, Mary K. Mitchell, Travis Alden, Paul Osterholt, Barbara Beaumont, Rebecca Reiter, Carol Spaziani, Helen Burford, Thad Long, Glen Keller, Chris Rushton, Duane Musser, Bill Young, Ron Bandy and interested citizens.

Mayor Pro Tem Soukup called a work session to order at 6:30 p.m.  City Administrator discussed commercial development and the pros and cons of incentives for added value.

Consent Agenda.  Bahl moved, seconded by Moody, to approve staff reports, renewal of Class C Beer and Class B Wine permits for Fareway Stores, November and December receipts, January 13 and January 20, 2004 City Council minutes, and payment of attached list of claims.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

League of Women Voters Regional Government Committee.  The Regional Government Committee of the League of Women Voters presented results of their survey of opinions of local leaders regarding sharing of municipal services.  The results show that cooperation between services agencies exists but needs to be improved.  It is the committee’s feeling that technology will provide the means for increased cooperation.  They look to the Johnson County Council of Governments to help facilitate changes in many areas.  Sharing of dispatch services for fire and police protection is the committee’s priority followed by sharing of fire and police facilities and equipment.

Community Center Roof.  Thad Long, SVPA Architects, and Glen Keller, Firestone rep, discussed warranties and the pros and cons of a mechanically fastened or fully adhered membrane roof for the existing community center.  Keller stated that, after a final inspection by the City, the installing contractor and the Firestone rep, the installing contractor will warranty the roof for labor and tightness for two years.  After that, or if the installing contractor is not available, Firestone will provide the warranty.  A 45 or 60 mil membrane qualifies for a 15-year warranty.  A 60-mil membrane is specified for the community center roof.  There is an extra charge for a 20-year warranty.  Warranty conditions include annual inspection and cleaning of drains and mechanical covers.  After discussion, Moody moved, seconded by Soukup, to approve the change order for installation of a fully-adhered membrane roof on the existing community center at a cost of $84,478.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Cherry Creek Center.  Council reviewed the proposed site plan for the Cherry Street Center commercial building.  The Planning and Zoning Commission recommends approval of the site plan. After discussion, Bahl moved, seconded by Gardiner, to adopt Resolution No. 04-01, RESOLUTION APPROVING THE COMMERCIAL DEVELOPMENT SITE PLAN FOR CHERRY CREEK CENTER.  The vote was:  ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Penn Meadows Addition—Part IV.  Soukup moved, seconded by Salm, to approve the second consideration of Ordinance No. 04-01, AN ORDINANCE AMENDING THE ZONING ORDINANCE BY CHANGING THE USE REGULATIONS ON PROPERTY OWNED BY H&O LC TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE RS-6 SINGLE FAMILY RESIDENCE DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Liberty Centre.  Salm moved, seconded by Moody, to approve the third consideration of Ordinance No. 03-39, AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE USE REGULATIONS ON PROPERTY OWNED BY THE FORD A. WORK ESTATE AND THE ELEANOR M. WORK ESTATE TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE RS-6 SINGLE FAMILY RESIDENCE DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Bahl moved, seconded by Salm, to adopt Ordinance No. 03-39.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Salm moved, seconded by Bahl, to approve the third consideration of Ordinance No. 03-41, AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE USE REGULATIONS ON PROPERTY OWNED BY THE FORD A. WORK ESTATE AND THE ELEANOR M. WORK ESTATE TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE RD-8 TWO-UNIT FAMILY RESIDENCE DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Bahl moved, seconded by Moody, to adopt Ordinance No. 03-41.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Moody moved, seconded by Bahl, to approve the third consideration of Ordinance No. 03-42, AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE USE REGULATIONS ON PROPERTY OWNED BY THE FORD A. WORK ESTATE AND THE ELEANOR M. WORK ESTATE TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE RD-10 TWO-UNIT FAMILY RESIDENCE DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Soukup moved, seconded by Salm, to adopt Ordinance No. 03-42.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Bahl moved, seconded by Soukup, to approve the third consideration of Ordinance No. 03-46, AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE USE REGULATIONS ON PROPERTY OWNED BY THE FORD A. WORK ESTATE AND THE ELEANOR M. WORK ESTATE TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE RM-12 MULTI-FAMILY RESIDENCE DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Soukup moved, seconded by Moody, to adopt Ordinance No. 03-46.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Bahl moved, seconded by Salm, to approve the third consideration of Ordinance No. 03-47, AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE USE REGULATIONS ON PROPERTY OWNED BY THE FORD A. WORK ESTATE AND THE ELEANOR M. WORK ESTATE TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE C-1-B GENERAL COMMERCIAL DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Soukup moved, seconded by Moody, to adopt Ordinance No. 03-47.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Bahl moved, seconded by Gardiner, to approve the third consideration of Ordinance No. 03-48, AN ORDINANCE AMENDING THE ZONING CODE TO CHANGE THE USE REGULATIONS ON PROPERTY OWNED BY THE FORD A. WORK ESTATE AND THE ELEANOR M. WORK ESTATE TO THOSE SET FORTH IN THE NORTH LIBERTY ZONING CODE FOR THE C-2-A HIGHWAY COMMERCIAL DISTRICT.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

Soukup moved, seconded by Gardiner, to adopt Ordinance No. 03-48.  After discussion, the vote was: ayes—Bahl, Gardiner, Moody, Salm, Soukup; nays—none.  Motion carried.

City Administrator.  James reminded Council members that the Iowa League of Cities is sponsoring a legislative day on February 18 to give local officials the opportunity to voice their concerns to state legislators.

Adjournment.  Bahl moved, seconded by Moody, to adjourn the meeting at 8:20 p.m.  Motion carried.
