The North Liberty City Council met in special session in Council Chambers.  Mayor Pro Tem Bahl called the meeting to order at 6:00 p.m.

Council members present: Bahl, Franker, Gardiner, Moody and Salm.

Also present were Brian James, Mary K. Mitchell, Travis Alden, Dave Roberts, Sam Luckel, Heather McElvain, Paul Osterholt, Jason Harder, Betty Moey, Kurt Hamann and interested citizens.

West Lake Addition – Part Two.  City Administrator reported that the Iowa Department of Natural Resources has issued a construction permit for the sanitary sewer in West Lakes Addition that will allow a maximum 60 dwelling units to be connected to the sanitary sewer system prior to connection to a gravity trunk main.  The DNR permit allows hauling of the sewage from the lift station holding tank to the wastewater treatment plant until the west trunk main is completed, expected to be the fall of 2006, and sets forth conditions for the hauling and monitoring of the lift station operation.  Using the average sewage per dwelling unit, it is calculated that the lift station tank would need to be pumped a minimum of two times each day when the full 60 units are built.  Harder has an agreement with Jim’s Septic Service to be the principal hauler and Brown’s Concrete and Backhoe to be the backup hauler.  An operational agreement that sets forth procedures for monitoring the hauling and maintenance of the lift station, a backup plan and an agreement that the developer will pay all costs for the hauling contract, maintenance of the sewer lines and city staff time for monitoring the dumping and lift station operation will be required.

Citizens expressed concerns about the daily hauling of sewage.  They asked the Council to require completion of the gravity sewer main prior to granting any occupancy permits so that no hauling would be required.  Franker agreed that development should wait until the gravity sewer is completed.

An alternate plan for construction of the sewer trunk main by the developer with partial reimbursement of the cost by the City was discussed.  Costs would be apportioned to the entire service area of the trunk line according to use area and charged back as connection fees when development occurs.  It was the consensus of the Council to pursue that option in an effort to get the project completed sooner.

The final plat of West Lake Addition – Part Two was presented.  The Planning & Zoning Commission recommends approval of the final plats of Parts Two through Eight.  Salm moved, seconded by Moody, to adopt Resolution No. 05-151, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART TWO.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.  Motion carried.  Council members noted that their approval of the plats is based on the proposal for a timely completion of the sanitary sewer trunk main to minimize or eliminate any sewage hauling.

West Lake Addition – Part Three.  The final plat of West Lake Addition – Part Three was presented.  Moody moved, seconded by Salm, to adopt Resolution No. 05-152, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART THREE.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

West Lake Addition – Part Four.  The final plat of West Lake Addition – Part Four was presented.  Moody moved, seconded by Salm, to adopt Resolution No. 05-153, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART FOUR.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

West Lake Addition – Part Five A.  The final plat of West Lake Addition – Part Five A was presented.  Moody moved, seconded by Gardiner, to adopt Resolution No. 05-154, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART FIVE A.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

West Lake Addition – Part Five B.  The final plat of West Lake Addition – Part Five B was presented.  Moody moved, seconded by Salm, to adopt Resolution No. 05-162, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART FIVE B.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

West Lake Addition – Part Six.  The final plat of West Lake Addition – Part Six was presented.  Moody moved, seconded by Salm, to adopt Resolution No. 05-155, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART SIX.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

West Lake Addition – Part Seven.  The final plat of West Lake Addition – Part Seven was presented.  Salm moved, seconded by Moody, to adopt Resolution No. 05-156, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART SEVEN.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

West Lake Addition – Part Eight.  The final plat of West Lake Addition – Part Eight was presented.  Salm moved, seconded by Moody, to adopt Resolution No. 05-157, RESOLUTION APPROVING PLAT AND SUBDIVISION OF WEST LAKE ADDITION – PART EIGHT.  After discussion, the vote was: ayes—Bahl, Franker, Gardiner, Moody, Salm; nays—none.

2005 Sidewalk Program.  City Clerk reported that because of agreements with property owners, sidewalks will be completed without an assessment program.

Adjournment.  Franker moved, seconded by Gardiner, to adjourn the meeting at 6:58 p.m.  Motion carried.
