NORTH LIBERTY PLANNING COMMISSION
July 1, 2008
At 6:30 p.m., Vice-Chair Mausser called the meeting to order.
Commission members present: Candace Daniels, Eric Foresman, Bill Mausser, Doug Peters, Natlie Wilkerson. Two positions on the Commission are currently vacant.
Others present: Ryan Heiar, City Administrator; Dean Wheatley, City Planner; Scott Peterson, City Attorney; Kevin Trom, City Engineer; Tracey Mulcahey, City Clerk; Arie Hovenkamp; Dan Wall, Howard R. Green Company; Kelly Beckler, MMS Consultants; Bill Peterson, William Peterson Architects; and other interested citizens.
PUBLIC COMMENT. No public comment was received.
CONDITIONAL USE: Request of United States Post Office to allow for the outside storage of postal vehicles in the C-2-A district at 75 Commercial Drive. (Lot 1 of Green Subdivision)
City Planner Wheatley presented a summary of the case. The post office is seeking a conditional use to authorize the outdoor storage of postal vehicles. Staff recommends approval with no conditions.
At 6:35 p.m., the public hearing was opened. No oral or written comments were received. The public hearing was closed.
Dan Wall from Howard R. Green Company presented the proposed improvements.
Peters moved, Wilkerson seconded to recommend approval of this application to the Board of Adjustments. The vote was: ayes – Mausser, Foresman, Daniels, Peters, Wilkerson; nays – none. Motion carried.
FINAL PLAT: Request of JDHP Development to approve West Lake Addition Part 12, a resubdivision of West Lake Part 9.
Wheatley presented the case. This is a resubdivision of a lot to move the common lot line between two existing lots. Staff recommends approval.
Kelly Beckler from MMS Consultants presented the final plat. The church that is planning to build at this site is seeking additional land for parking. An additional access easement will be added at the time of site plan to the lot.
No public comment was received.
Mausser inquired about the turn about in lot two with only one being shown in easement.
Foresman made a motion to recommend approval of the application to City Council, Daniels seconded the motion. The vote was: ayes – Peters, Wilkerson, Daniels, Mausser, Foresman; nays – none. Motion carried.
SITE PLAN: Request of Ace Electric to approve a site plan at 1280 Progress Street, the northeast corner of the intersection of Progress Street and 240th Street. (Lot 5, Deerfield First Addition)
Wheatley presented information regarding the application for the building. Staff recommends approval with applicant considering a different fence material along 240th Street instead of the woven chain link fence.
Bill Peterson of William Peterson Architects presented the application.
No public comment was received.
Wilkerson moved to recommend approval of the application for Ace Electric Site Plan. Mausser seconded. The vote was: ayes – Foresman, Wilkerson, Peters, Daniels, Mausser; nays – none. Motion carried.
CONDITIONAL USE: Request of Ace Electric to approve a conditional use application for outside storage associated with their proposed new development at 1280 Progress Street. (Lot 5, Deerfield First Addition)
Wheatley summarized the application for outdoor storage for Ace Electric. Staff recommends approval.
The public hearing was opened at 6:51 p.m. No oral or written comment were received. The public hearing was closed.
Peters moved, Wilkerson seconded to recommend approval of the conditional use request to the Board of Adjustments. The vote was: ayes – Mausser, Peters, Daniels, Foresman, Wilkerson; nays – none. Motion carried.
ORDINANCE AMENDMENT: Ground sign size. Wheatley presented the proposed change with photos and explanations of the City’s current ordinance. After the discussion, Wilkerson moved, Foresman seconded to leave the current ordinance as it stands. The vote was: ayes – Daniels, Foresman, Mausser, Peters, Wilkerson; nays – none. Motion carried.
ORDINANCE AMENDMENT: Masonry on corner side yard building elevations.
Wheatley presented the following options for amending the masonry requirement for residential units.
- Continue to require corner side yard at major street intersections.
- Eliminate it on sides only on fronts.
- Delete masonry requirement but add requirement for at least two trees.
Peters moved to eliminate the requirement for masonry on the side of residential structures and only require it on the front side subject to clarification of the language in the ordinance to ensure that the reference to residential only is clear. After discussion, the vote was: ayes – Foresman, Wilkerson, Peters, Daniels, Mausser; nays – none. Motion carried.
BYLAWS AMENDMENT: At the June meeting amendments to the bylaws were discussed. City Attorney Peterson presented the proposed changes to the bylaws. Council does not have to approve the bylaws, only Commission.
No public comment was received.
Wilkerson moved, Mausser seconded to approve the amended bylaws. The vote was: ayes – Wilkerson, Peters, Foresman, Mausser, Daniels; nays – none. Motion carried.
MINUTES. Wilkerson moved, Foresman seconded to approve the minutes from the June 2008 Commission meeting. The vote was all ayes. Motion carried, minutes approved.
OLD BUSINESS. Wheatley updated the Commission on Cases under Development including the Alberhasky rezonings and preliminary plat.
Wheatley stated that if the Commission members have anyone in mind to apply for the two vacancies, the city would like to fill the positions as soon as possible.
Foresman discussed with staff scheduling a meeting to talk about implementing green practices.
NEW BUSINESS. None presented.
CASES UNDER DEVELOPMENT. Wheatley reported that if the school timeline requires it, the Planning and Zoning Commission may be asked to consider a special meeting to consider the application.
ADJOURNMENT. Wilkerson moved, Daniels seconded to adjourn at 7:25 p.m. All ayes. Meeting adjourned.
