PLANNING COMMISSION
MINUTES
January 6, 2009

Chair Mausser called the meeting to order at 6:30 p.m. Commission members present:  Haack, Mausser, Moore, Peters, Wilkerson; absent – Foresman.

Peters moved, Moore seconded to approve the agenda.  The vote was: ayes – Wilkerson, Peters, Moore, Mausser, Haack; absent – Foresman. Motion carried.

Others present:  Dean Wheatley, City Planner; Ryan Heiar, City Administrator; Scott Peterson, City Attorney; Kevin Trom, City Engineer; Tracey Mulcahey, City Clerk; Corinne Lemmage; Tom Salm; and other interested citizens.

Public Comment. No public comment was offered.

RL Rental Subdivision – Preliminary Plat.

Wheatley presented the Request of Robert and Robin Schulty to approve “RL Rental Subdivision,” a 2-lot resubdivision of existing Lot 5, Deerfield First Addition, at the northeast corner of 240th Street and Progress Street.  He reported on the Good Neighbor Meeting. No one attended the meeting.  This application creates two lots from an existing platted lot.

Doug Frederick from Hart – Frederick Consultants presented the request for preliminary plat.  No additional public utilities will be required.  The applicant has addressed all staff issues.

No public comment was received.

Wilkerson moved, Peters seconded to recommend approval of the Preliminary Plat to City Council. The vote was: ayes – Wilkerson, Mausser, Peters, Moore, Haack; nays – none; absent – Foresman. Motion carried.

City Tractor Site Plan

Wheatley presented the requests from City Tractor presented the request of City Tractor Inc to approve a site plan for a new City Tractor development at the northwest corner of Penn Court and Lininger Lane.

Duane Musser, MMS Consultants, and John Conrads, City Tractor, presented information regarding the application.  The applicant provided samples of the building materials that will be used on the building. The applicant reported that the application meets all site plan requirements. The storm sewer extension relating to the property is being worked out.

No public comment was received.

The Commission inquired about parking flow on the lot.

Peters moved, Moore seconded to recommend approval of the Site Plan application to City Council with the following conditions:

1. Regarding outside display and storage:

a. That no equipment is displayed at any time outside the areas identified on the approved site plan.

b. That no equipment that extends vertically, such as lifts of any kind, backhoes, or other similar equipment, shall be stored in its extended position. All equipment is to be fully compressed or

compacted.

c. That display is limited to complete equipment and major equipment components only.

d. That no maintenance or repair work is to be performed in the display areas.

2. That glare shields on wall lights are used to prevent glare from adjacent properties.

3. That site parking is authorized to be reduced from the required 43 to 38, as shown on this plan, based on information provided by the owner.

4. That the storm sewer planned along the west side of the lot is installed prior to an occupancy permit.

The vote was: ayes –Peters, Moore, Haack, Wilkerson, Mausser; nays – none; absent – Foresman. Motion carried.

City Tractor Conditional Use.

Wheatley presented the request of City Tractor to approve a conditional use application for outside storage at a new City Tractor development at the northwest corner of Penn Court and Lininger  Lane.

Staff recommends approval with the following conditions: that no equipment is displayed at any time outside the areas identified on the approved site plan; that no equipment that extends vertically, such as lifts of any kind, backhoes, or other similar equipment, shall be stored in its extended position, all equipment is to be fully compressed or compacted; that display is limited to complete equipment and major equipment components only; that no maintenance or repair work is to be performed in the display areas.

Conrads presented that the outdoor storage will be outdoor display to encourage sales. Conrads encouraged all to go see the dealership in Coralville to see the outdoor storage.

The Council inquired about the fences on the development.

Haack moved, Moore seconded to recommend approval of the Conditional Use application to the Board of Adjustment with the following conditions:

  1. That no equipment is displayed at any time outside the areas identified on the approved site plan.
  2. That no equipment that extends vertically, such as lifts of any kind, backhoes, or other similar equipment, shall be stored in its extended position. All equipment is to be fully compressed or compacted.
  3. That display is limited to complete equipment and major equipment components only.
  4. That no maintenance or repair work is to be performed in the display areas.

The vote was: ayes – Haack, Mausser, Peters, Wilkerson, Moore; nays – none; absent – Foresman. Motion carried.

City of North Liberty Urban Renewal Area Amendment

Wheatley presented the requested amendment initiated by the City of North Liberty to add the new Iowa City Community School District site to the existing Urban Renewal Area.  The area added is designated for the new ICCSD school. The inclusion is necessary so that the City can utilize TIF for the gym expansion.

No public comments were received.

Wilkerson moved, Haack seconded to recommend approval to the City Council. The vote was: ayes – Peters, Haack, Wilkerson, Mausser, Moore; nays – none; absent – Foresman. Motion carried.

Minutes. Peters moved, Moore seconded to approve the minutes from the November 4, 2008 Commission Meeting. The vote was: ayes – Moore, Mausser, Haack, Wilkerson, Peters; nays – none; absent – Foresman. Motion carried.

Old Business. No old business was offered.

New Business. Wheatley reported that the City is still getting lots of interest in development in North Liberty even though the economy has slowed.  Wheatley asked if the Commission would be willing to review the land use policy map.

The Commission reviewed the cases under development.

Adjournment. At 7:25 p.m. Wilkerson moved, Mausser seconded to adjourn. All ayes. Meeting adjourned.
