At 5:30 p.m., Mayor Salm called the special meeting to order.
Council members present: Bahl, Kuhl, Moody, Wilkerson, Wozniak.
Others present: Acting City Administrator Tracey Mulcahey, City Attorney Scott Peterson, Clear Creek Amana School Board members – Jim Seelman, Tim Hennes, and Kevin Kinney; Doug DuCharme, Shive-Hattery; Paula Vincent, CCA Superintendent; David Zylstra, CCA Attorney; Sarah Smith; and Paul Osterholt.
Kuhl moved, Bahl seconded to approve the agenda. The vote was: ayes – Bahl, Wilkerson, Moody, Wozniak, Kuhl; nays – none. Motion carried.
Discussion was held regarding the 28E agreement between the Clear Creek Amana School District and the City of North Liberty for the city’s contribution of $500,000 toward the construction of the expanded gymnasium facility at the new elementary in North Liberty. The council expressed concerns regarding the term of the agreement. The proposed document has a ten year initial term with two five year renewable periods at North Liberty’s discretion. The remedy for default was proposed as being a repayment clause for the first ten year period. After lengthy discussion, consensus was reached among North Liberty Council that they would prefer a repayment over the course of twenty years rather than ten. The School Board was amenable to allowing for installation of cable for television service and placement of plaque in the new school acknowledging North Liberty’s contribution. The attorneys will be working together to clean up the language for a final document to be presented.
At 6:30 p.m., Moody moved, Kuhl seconded to adjourn. All ayes. Meeting adjourned.
