April 22, 2008
Regular Session
At 7:00 p.m., Mayor Tom Salm called the regular meeting of the North Liberty City Council to order.
Council members present: Chipman, Donahue, Hoffman, Kuhl, Wozniak.
Others present: City Administrator Ryan Heiar, City Attorney Erek Sittig, Assistant City Administrator Tracey Mulcahey, City Planner Dean Wheatley, Arie Hovenkamp, Lori Lindner, and other interested citizens.
Agenda.
Donahue moved, Kuhl seconded to approval the agenda with Resolution Number 08-32 being approved as a separate item rather than in the consent agenda. After discussion, the vote was: ayes – Hoffman, Wozniak, Chipman, Kuhl, Donahue; nays – none. Motion carried.
Consent Agenda.
Hoffman moved, Chipman seconded to approve the consent agenda with monthly departmental reports, Wastewater Treatment Plant Pay Application #12, Staab Construction, $829,883, Wastewater Treatment Plant Change Order #5, Staab Construction, $17,044, and the attached list of bills. The vote was: ayes – Wozniak, Kuhl, Chipman, Donahue, Hoffman; nays – none. Motion carried.
Assessment of Delinquent Amounts.
Kuhl moved, Chipman seconded to approve Resolution 08-32, Authorizing the Assessment of Delinquent Amounts Owed to the City of North Liberty, Iowa to Individual Taxes. After discussion, the vote was: ayes – Chipman, Kuhl, Donahue, Hoffman, Wozniak; nays – none. Motion carried.
Proclamations.
Mayor Salm proclaimed the following: Architecture Month for the month of April, Older Americans Month for the month of May, and Cover the Uninsured Week for the week of April 27 to May 3.
Public Comment.
Randy Hedin expressed concern regarding summer hours for the Community Center. The Community Center will close on Saturday and Sunday at 6 p.m. during the summer. This affects his church group that meets at 5:30 p.m. on Saturdays. Hedin is concerned about the extra fee required for his group to be allowed to have their service at 5:30 p.m. He expressed concerns regarding kids using the recreation center and families having access later in the evening rather than earlier in the day.
City Attorney Report.
Assistant City Attorney Sittig had nothing to report.
City Engineer Report.
No City Engineer report was presented.
City Administrator Report.
City Administrator Heiar reported that on Thursday, April 24 at 7:30 a.m., the KCRG “Our Town” breakfast and input session would be held. City wide clean up is Saturday, April 26 from 7:00 a.m. to 12:00 p.m. at the City Shop. Heiar will be attending the Chamber Legislative Breakfast on Saturday, April 26. Heiar presented information regarding the press conference on Amtrak feasibility study in bringing rail from Quad Cities to Iowa City. The track would carry approximately 187,000 passengers per year with a cost of $55,000,000 in capital expenses and $11,000,000 to operate. Heiar has been contacting property owners regarding potential sites for offsite city hall. He expects to have information to present to Council soon. City Administrator Heiar summarized the Policy/Ordinance Updates.
Mayor Salm reported on the Joint Communications Policy Board first meeting. Salm offered to answer questions after the meeting. A number of uses other than dispatch will be housed in the facility. The County intends to start construction in August.
Animal Ordinance Revisions.
Kuhl moved, Hoffman seconded to approve the second consideration of Ordinance Number 08-19, An Ordinance Amending the Pet Ordinance. After discussion, the vote was: ayes – Donahue, Kuhl, Wozniak, Chipman, Hoffman; nays – none. Motion carried.
Waste Water Treatment Plant SRF Issuance.
Hoffman moved, Kuhl seconded to approve Resolution Number 08-33, A Resolution authorizing and approving a Loan and Disbursement Agreement and providing for the issuance and securing the payment of Sewer Revenue Bonds. The vote was: ayes – Kuhl, Chipman, Hoffman, Donahue, Wozniak; nays – none. Motion carried.
Post-Construction Stormwater Runoff Control Ordinance.
Donahue moved, Hoffman seconded to approve the first consideration of Ordinance Number 08-11.a, An Ordinance Amending Chapter 13 of the North Liberty Municipal Code adding Section 13.23,“Post-Construction Stormwater Runoff Control Ordinance” with the new amendment clarifying the priorities. The vote was: ayes – Donahue, Hoffman, Kuhl, Wozniak, Chipman; nays – none. Motion carried.

New Business.
Councilor Kuhl was with Josh Schamberger of ICCVB at the Department of Cultural Affairs when Schamberger presented application to call Iowa City, Coralville, and North Liberty an Iowa Great Place.
Councilor Kuhl & Councilor Hoffman accepted award on behalf of the city regarding the city participating in the Cool Cities Initiative. Councilors Kuhl & Hoffman encouraged the City to promote education of our residents to assist in the green effort.
