September 8, 2009
Regular Session

At 7:00 p.m., Mayor Salm called the September 8, 2009 regular session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Hoffman, Kuhl and Wozniak; absent – none.

Others present: Ryan Heiar, City Administrator; Erek Sittig, Assistant City Attorney; Tracey Mulcahey, Assistant City Administrator; Kevin Trom, City Engineer; Dean Wheatley, City Planner; Cheryle Caplinger; Nick Bergus; Bill Mausser; Tom Palmer; Don Colony; Tina Dubois and other interested parties.

Approval of the Agenda. Kuhl moved, Chipman seconded to approve the agenda. The vote was: ayes – Hoffman, Wozniak, Chipman, Kuhl, Donahue; nays – none. Motion carried.

Consent Agenda. Hoffman moved, Kuhl seconded to approve the Consent Agenda including City Council Minutes- Regular Meeting- August 25, 2009; Liquor License Renewal for Johncy’s Liquor Store, Class E with Carryout Beer/Wine and Sunday Sales endorsements; Cornerstone Nature Area Project Pay Application Number 1 to Iowa Bridge and Culvert, $71,250.00; and the attached list of Claims. The vote was: ayes – Wozniak, Kuhl, Donahue, Hoffman, Chipman; nays – none. Motion carried.

Public Comment. Tina Dubois the North Liberty Community Food Pantry Coordinator reported that the coats, socks and underwear distribution will be held on September 26. Donations are still needed for coats. Donations and new or gently used coats can be dropped off at Corridor Coffee, Flip Salon, US Bank and the United Methodist Church.

City Engineer Report. City Engineer Kevin Trom reported on the following projects:
1. Cornerstone Nature Area. The bridge is complete. Bridge approaches have been poured. The contractor is making good progress.
2. ASR Well project. Construction is moving right along on this project.
3. Safety Study. A van tour was held with Dean Wheatley, Trom, Don Colony, Jim Warkentin and two JCCOG staff.

City Administrator Report. City Administrator Heiar offered the following updates:
• Joint Meeting of the County, Coralville, Iowa City and Iowa City School District will be held on September 16 at Johnson County Health/Human Services Building at 4 p.m.
• Fun Run will be held on September 20. Registration begins at 8:30 a.m.
• TIGER grant application will be submitted for $37.7 million.
• Budget preliminary planning will begin with a work session in October to get the general direction of the upcoming budget year.
• Financial model is being constructed and is expected by the end of the year.
Street Financial Report FY 2009. ¬ Donahue moved, Hoffman seconded to approve Resolution Number 09-107, A Resolution Approving the Official Financial Report for City Streets for the Fiscal Year ending June 30, 2009. The vote was: ayes – Donahue, Chipman, Kuhl, Wozniak, Hoffman; nays – none.

IJOBS Street Projects. Heiar summarized the IJOBS program and the street projects planned. Wozniak moved, Kuhl seconded to approve Resolution Number 09-108, A Resolution Accepting the bids for the 2009 Street Maintenance Projects in the City of North Liberty, Iowa. After discussion, the vote was: ayes – Kuhl, Hoffman, Donahue, Chipman, Wozniak; nays – none. Motion carried.

Chipman moved, Kuhl seconded to approve Resolution Number 09-109, A Resolution relating to financing of a proposed project to be undertaken by the City of North Liberty, Iowa; establishing compliance with reimbursement bond regulations under the Internal Revenue Code. After discussion, the vote was: ayes – Hoffman, Chipman, Wozniak, Donahue, Kuhl; nays – none. Motion carried.
Trails Plan. At 7:14 p.m., Mayor Salm opened the Public hearing regarding the Trails Plan. Chipman inquired if any comments have been received. Heiar answered that city staff has not. The public hearing was closed.

Parks Plan. Donahue moved, Wozniak seconded to remove the Parks Plan item from the table. The vote was: ayes – Chipman, Wozniak, Hoffman, Kuhl, Donahue; nays – none.

At 7:15 p.m., Mayor Salm opened the public hearing regarding the Parks Plan. Dan Skemp, chairman of the Parks Board, spoke regarding the proposed Parks Plan and a history of how the City arrived at this point. Councilor Chipman asked Council to seriously examine the amount of funding the city is willing to commit to the plan. Councilor Hoffman asked for timeframes to be attached to the document. Councilor Wozniak asked about the prioritization of projects and Council consideration of an open space policy. The public hearing was closed.

Kuhl moved, Hoffman seconded to approve Resolution Number 09-106, A Resolution Accepting the Parks Plan for the City of North Liberty. After discussion, the vote was: ayes – Kuhl, Donahue, Hoffman, Wozniak, Chipman; nays – none. Motion carried.

Downtown Property Acquisition. Donahue moved, Hoffman seconded to approve Resolution Number 09-110, A Resolution relating to financing of a proposed project to be undertaken by the City of North Liberty, Iowa; establishing compliance with reimbursement bond regulations under the Internal Revenue Code. The vote was: ayes – Wozniak, Chipman, Hoffman, Donahue, Kuhl; nays – none. Motion carried.

Sex Offender Policy. Hoffman moved, Chipman seconded to approve Resolution Number 09-111, A Resolution Approving the Policy regarding Library Access for Sex Offenders against Minors for the City of North Liberty, Iowa with a carbon copy of the letter granting permission being sent to the appropriate authorities that provided the information that allowed the granting of permission. After discussion, the vote was: ayes – Donahue, Wozniak, Kuhl, Chipman, Hoffman; nays – none. Motion carried.

Liberty Centre, Part 8. Hoffman moved, Wozniak seconded to approve Resolution Number 09-112, A Resolution Approving the Final Plat and Authorizing Acceptance of Improvements for Liberty Centre, Part Eight, North Liberty, Iowa. After discussion, the vote was: ayes – Kuhl, Hoffman, Donahue, Chipman, Wozniak; nays – none. Motion carried.

Sanitary Sewer and Water Service Installer Licensing Ordinance. At 7:39 p.m., Mayor Salm opened the public hearing regarding sanitary sewer and water service installer licensing ordinance. Palmer presented information regarding the ordinance update. The public hearing was closed.

Hoffman moved, Kuhl seconded to approve the first consideration of Ordinance Number 09-11, An Ordinance Amending Chapter 15 of the North Liberty Municipal Code entitled “Buildings and Construction” by adopting a new Chapter 15.04 entitled “License Required” setting forth the requirements for licensing of sanitary sewer and water service installers in the City of North Liberty, Iowa. The vote was: ayes – Hoffman, Donahue, Chipman, Wozniak, Kuhl; nays – none. Motion carried.

Parking Regulations Ordinance. At 7:41 p.m., Mayor Salm opened the public hearing regarding amended parking regulations. Council discussed the proposed regulations. The public hearing was closed.

Chipman moved, Wozniak seconded to approve the first consideration of Ordinance Number 09-12, An Ordinance amending Chapter 10.36, entitled “Stopping, Standing and Parking,” of the North Liberty Municipal Code by Amending Section 10.36.050 to prohibit parking on certain streets in the City of North Liberty, Iowa. The vote was: ayes – Donahue, Chipman, Wozniak, Kuhl, Hoffman; nays – none. Motion carried.

Curfew Ordinance. At 7:45 p.m., Mayor Salm opened the public hearing regarding Curfew Ordinance amendment. Sittig provided an update regarding the Code amendment. Council discussed the curfew ordinance. The public hearing was closed.

Donahue moved, Hoffman seconded to approve the first consideration of Ordinance Number 09-13, An Ordinance amending City of North Liberty Code of Ordinances, Title 9 (“Public Peace, Morals and Welfare”) by deleting Current Chapter 9.04 (“Curfew for Minors”) and inserting new Chapter 9.04 (“Curfew for Minors”). After discussion, the vote was: ayes – Chipman, Wozniak, Kuhl, Hoffman, Donahue; nays – none. Motion carried.

Cedar Springs Rezoning. Donahue moved, Wozniak seconded to approve the second consideration of Ordinance Number 09-10, An Ordinance Amending the Zoning Ordinance to change the use regulations on property owned by Cedar Springs Partners, LLC, located in North Liberty, Iowa to those set forth in the North Liberty Municipal Code for the RD-10 Duplex Residential District. After discussion, the vote was: ayes – Wozniak, Kuhl, Hoffman, Donahue, Chipman; nays – none. Motion carried.

New Business. Councilor Wozniak reported that there is a JCCOG meeting tomorrow. JCCOG conducted research and will present at an upcoming meeting on red light cameras.

At 7:57 p.m., Kuhl moved, Hoffman seconded to adjourn. All ayes. Meeting adjourned.
