March 22, 2011
Regular Session
Call to order. At 7:00 p.m., Mayor Salm called the March 22, 2011 Regular Session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Hoffman, Kuhl, and Wayson.
Others present: Ryan Heiar, Scott Peterson, Kevin Trom, Tracey Mulcahey, Dean Wheatley, Erika Harper and other interested parties.
Approval of the Agenda. Donahue moved, Hoffman seconded to approve the agenda with moving Quail Creek Golf Course Liquor License Application and the pay estimate for the Highway 965 project to after the Consent Agenda. The vote was: ayes – Donahue, Kuhl, Wayson, Hoffman, Chipman; nays – none. Motion carried.
Consent Agenda. Chipman moved, Wayson seconded to approve the Consent Agenda including City Council Minutes from the Regular Meeting held on March 8, 2011; the attached list of Claims; February Revenues; the Liquor License Renewal for Charlotte’s, a Class C Liquor License with Sunday Sales, Outdoor Service, Catering Privilege, and Carryout Wine endorsements; Liquor License Renewal for Roadies, a Class C Liquor License with Sunday Sales and Outdoor Service endorsements;Liquor License Renewal for Gasby’s #2 – Hawkeye Drive, a Class C Liquor License with Sunday Sales Endorsement; Liquor License Application for Ducks Unlimited Event – April 7, 2011, a Class C – Five Day Liquor License; and the Liquor License Application for Pancheros Mexican Grill, a Class B Wine Coolers and Sunday Sales. The vote was: ayes – Kuhl, Hoffman, Chipman, Wayson, Donahue; nays – none. Motion carried.
Quail Creek Golf Course. Council discussed the Fire Department’s report on the issue. A resident of the condominiums at 820 Clubhouse Road expressed concern regarding the condition of the driveway. The Mayor reported on the Fire Department’s recommendation that the road be brought up to minimum standards for safety issues by September 1. Council discussed the reconstruction of the driveway. The owner is planning to make repairs in the next thirty days.
Kuhl moved to approve the Liquor License Renewal for Quail Creek Golf Course, a Class B Beer and Wine License with Sunday Sales, Outdoor Service and Living Quarters endorsements subject to the road being repaired to a standard of being able to handle emergency vehicle on or before June 1, with the owner being required to come back to council if that can’t be obtained, Donahue seconded. After discussion, the vote was: ayes – Kuhl; nays – Chipman, Donahue, Wayson, Hoffman. Motion fails.
Donahue moved to approve the Liquor License Renewal for Quail Creek Golf Course, a Class B Beer and Wine License with Sunday Sales, Outdoor Service and Living Quarters endorsements subject to the road condition being reviewed on June 1, Hoffman seconded. After discussion, the vote was: ayes –Wayson, Chipman, Donahue, Hoffman, Kuhl; nays – none. Motion carried.
Pay Estimate #15, Highway 965, Phase I Project – Metro Pavers. Council discussed the pay estimate for Metro Pavers. Wayson moved, Chipman seconded to approve Pay Estimate #15, Highway 965, Phase 1 Project to Metro Pavers in the amount of $38,431.13. After discussion, the vote was: ayes – Donahue, Wayson, Hoffman, Kuhl, Chipman; nays – none. Motion carried.
Public Comment. No public comment was offered.
City Attorney Report. City Attorney Peterson reported on the agreements with the CRANDIC and ITC for the Golfview Drive project. The ITC item is expected to be ready for the April 12 meeting.
City Engineer Report. City Engineer Trom reported that the Jones Boulevard Project preconstruction meeting was held today. The project will start on April 4 with 140 working days. The project will start on the south end of Jones Boulevard.
Penn Street project bids have been opened and will be considered tonight.
The Golfview Drive connection project will have plans and specifications issued this week. The public hearing will be held on April 12, bids opened on April 20, and project for council consideration on April 26.
The Penn Meadows Rain Gardens preconstruction meeting is scheduled for next Monday.
The Dubuque Street Trail project will be let through the IDOT with an anticipated June start date.
The City’s project open house is scheduled for Thursday from 5:30 to 7:00 p.m. in the Community Center.
City Administrator Report. City Administrator Heiar provided a Highway 965 project update. His blog is back up and running. He hopes to have a good crowd for the project forum on Thursday evening.
Heiar presented additional information relating to the Holiday Lodge access concern.
Heiar updated Council on a new efficiency in the water department. With a new route numbering system, the rate of rereads has decreased by about 100 per month. Shut off notices are charged at $15 per posting.
Councilor Wayson asked about the Community Needs Survey. Wheatley reported a 31% return rate with an extension for returns to the end of the week.
Mayor Report. Mayor Salm requested consideration of moving the Fun Days Parade Route back to its original route.
City Administrator Reimbursement Authorization Policy. Donahue moved, Chipman seconded to approve Resolution Number 11-29, A Resolution Approving the Policy for Authorization of City Administrator Reimbursement Requests. The vote was: ayes – Wayson, Chipman, Donahue, Hoffman, Kuhl; nays – none. Motion carried.
Road Embargos. Kuhl moved, Wayson seconded to approve Resolution Number 11-30, A Resolution Approving Road Embargos for the City of North Liberty, Iowa. After discussion, the vote was: ayes – Hoffman, Donahue, Kuhl, Chipman, Wayson; nays – none. Motion carried.
Penn Street Widening Project. Donahue moved, Wayson seconded to approve Resolution Number 11-31, A Resolution Approving Temporary Construction Easement Agreements, Permanent Easement Agreement, and Real Estate Agreement for the Penn Street Improvement Project between Property Owners and the City of North Liberty, Johnson County, Iowa. The vote was: ayes – Chipman, Kuhl, Donahue, Wayson, Hoffman; nays – none. Motion carried.
Chipman moved, Wayson seconded to approve Resolution Number 11-32, A Resolution Accepting the Bid from Metro Pavers for the Penn Street Improvements 2011 Project. After discussion, the vote was: ayes – Donahue, Hoffman, Wayson, Kuhl, Chipman; nays – none. Motion carried.
Golfview Drive Improvement Project. Kuhl moved, Hoffman seconded to approve Resolution Number 11-33, A Resolution Approving Easement Agreement and Grade Crossing License Agreement with CRANDIC for the Golfview Drive Improvement Project. After discussion, the vote was: ayes – Wayson, Chipman, Kuhl, Hoffman; nays – Donahue. Motion carried.
City Hall/City Council Chambers Lease. Donahue moved, Kuhl seconded to approve Resolution Number 11-34, A Resolution Approving Lease Agreement between the City of North Liberty and Epley Properties, LLC. After discussion, the vote was: ayes – Hoffman, Donahue, Kuhl, Chipman, Wayson; nays – none. Motion carried.
Old Business. Wheatley reported that since no comments were received on the Sanitary Sewer study, final copies can be produced. Councilor Hoffman reported that he had a “mini sneak peak” at the Fire Department remodel. He is looking forward to a formal invitation to tour the facility. Other facility tours were discussed for upcoming work sessions.
New Business. Councilor Wayson commented on the new Police Department report. He offered kudos to the department on their good work. Councilor Hoffman thanked the Chief for the format of the new report.
