Regular Session
Call to order. At 7:00 p.m., Mayor Salm called the May 10, 2011 Regular Session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Hoffman, Kuhl, Wayson.
Others present: Ryan Heiar, Scott Peterson, Kevin Trom, Tracey Mulcahey, Dean Wheatley, Erika Harper and other interest parties.
Approval of the Agenda. Chipman moved, Hoffman seconded to approve the agenda. The vote was: ayes – Kuhl, Wayson, Donahue, Hoffman, Chipman; nays – none. Motion carried.
Consent Agenda. Hoffman moved, Wayson seconded to approve the Consent Agenda including City Council Minutes from the Regular Meeting on April 26, 2011; the attached list of Claims; the Liquor License Application for Liberty Centre Blues and BBQ on May 29, 2011, Class B Beer with Sunday Sales and outdoor service endorsements; the Liquor License Renewal for Eggy’s adding Catering Privilege to existing Liquor License; Penn Meadows Park Rain Gardens Project to Dave Schmitt Construction, Pay Application Number 1 in the amount of $62,387.21; Highway 965 Project to Metro Pavers, Change Order Number 6 in the amount of $8,329.90; Highway 965 Project to Metro Pavers, Pay Application Number 17 in the amount of $88,415.43; Penn Street Project to Metro Pavers, Change Order Number 1 in the amount of $33,675.40; and the Jones Boulevard Project for Horsfield Construction, Change Order Number 1 in the amount of $16,643.16. After discussion, the vote was: ayes – Hoffman, Donahue, Wayson, Chipman, Kuhl; nays – none. Motion carried.
Public Comment. No public comments were offered.
City Attorney Report. City Attorney Peterson updated Council on the Closed Session item on the agenda. He had no new developments to report, but left it to Council’s discretion if they desire a closed session.
Peterson asked Council for feedback on the weapons prohibition discussion. Council was encouraged to contact Ryan Heiar with feedback.
Peterson spoke with the Iowa Citizens’ Aide Omsbudman’s Office who handled the complaint submitted regarding the City’s Open Records Policy. The complaint has been considered and closed. A revised policy will be coming to Council soon with modifications determined through the usage of the policy. Peterson encouraged the Council to convey concerns to staff for the revision.
Council discussed the complaint with the State Ombudsman. Regarding the weapons prohibition, Heiar clarified that staff is looking for further clarification and direction regarding this matter. It was decided to have the item on the first agenda in June for Council discussion.
City Engineer Report. City Engineer Trom reported on the progress on the Jones Boulevard Project. Several street closures will be required for short one day periods to cross streets with utilities. A letter will be sent to residents with the estimated closure date of Jones Boulevard as soon as contractor provides.
The Penn Street Project is getting close to Jones Boulevard with water main work. The project will be crossing Jones Boulevard soon. Trom is working with City staff to get information out to the public. The contractor is planning for either Thursday or Friday. The closing is projected to be relatively short. The change order considered by Council was for panel replacements.
All of the rock base is in for the Penn Meadows Park Parking Lot Project. Forevergreen Nursery will be starting the rain garden work next week. The project is projected to be complete within a month.
Award notices have gone out for the Dubuque Street Trail and Golfview Drive Projects. Preconstruction meetings should be happening soon.
Trom will be attending a public works conference next week in Kansas.
City Administrator Report. City Administrator Heiar updated Council on upcoming meetings. The Transit Task Force is meeting on May 16. The meeting will focus on a detailed discussion of the Community Survey results. The Joint Planning and Zoning/City Council meeting is scheduled for May 17. The joint meeting of Johnson County communities and schools is scheduled for May 17 at the Coralville City Hall starting at 4:00 p.m. with a reception and meeting convening at 4:30 p.m.
At the next Council meeting, Heiar proposes a 6:30 p.m. start with a work session relating to the street facility project. He encouraged Council to let him know if they require additional information.
At an upcoming meeting, Heiar will present plans for the new Council Chambers. The final costs are being assembled.
Heiar reported that he had a good meeting regarding the personnel manual. He will be providing an update on that meeting this week. The manual will be placed on the next agenda for discussion and possible consideration.
The Ranshaw House roof project is under construction. The project bid was $29,000 with $8,000 in IJOBS grant funds. Councilor Kuhl asked about windows that are out on the house.
Mayor Report. Mayor Salm proclaimed May as Older Americans Month and as Building Safety Month.
Fun Days. Hoffman moved, Donahue seconded to approve Resolution Number 11-43, A Resolution authorizing the use of Penn Meadows Park and City equipment for Fun Days and authorizing temporary street closings for the event. After discussion, the vote was: ayes – Donahue, Chipman, Hoffman, Wayson, Kuhl; nays – none. Motion carried.
Fire Department Annual Report. Fire Chief Eric Vandewater presented the Annual Report of the Fire Department. Council discussed the report with Chief Vandewater. The Fire Department is hosting an open house on Friday, June 10 after the parade.
Corridor Commercial, Part 6, Preliminary Plat. Wheatley made the case presentation of the Preliminary Plat Application. Mausser reported that the Planning Commission recommended approval of the Preliminary Plat Application. Council discussed the application.
Donahue moved, Chipman seconded to approve Resolution Number 11-51, A Resolution Approving the Preliminary Plat of Corridor Commercial, Part 6, North Liberty, Iowa. The vote was: ayes – Wayson, Hoffman, Donahue, Chipman; nays – Kuhl. Motion carried.
Liberty Centre Blues and BBQ. Wayson moved, Kuhl seconded to approve Resolution Number 11-52, A Resolution authorizing an additional temporary Street Closing for Liberty Centre Blues and BBQ. After discussion, the vote was: ayes – Kuhl, Chipman, Wayson, Hoffman, Donahue; nays – none. Motion carried.
Chipman moved, Kuhl seconded to approve Resolution Number 11-53, A Resolution approving a Fireworks Permit for the Liberty Centre Blues and BBQ Event on May 29, 2011. The vote was: ayes – Hoffman, Wayson, Donahue, Chipman, Kuhl; nays – none. Motion carried.
Property Disposal. Donahue moved, Hoffman seconded to approve Resolution Number 11-54, a Resolution Authorizing disposal of Property owned by the City of North Liberty. The vote was: ayes – Chipman, Kuhl, Wayson, Donahue, Hoffman; nays – none. Motion carried.
Library Expansion Project. Hoffman moved, Chipman seconded to approve Resolution Number 11-55, A Resolution Approving the Services Agreement between the City of North Liberty and Neumann Monson, P.C. for services relating to the Library Expansion Project, North Liberty, Iowa. After discussion, the vote was: ayes – Donahue, Wayson, Kuhl, Hoffman, Chipman; nays – none. Motion carried.
Administrative Ordinance Update. Donahue moved, Kuhl seconded to approve the second consideration of Ordinance Number 11-03, An Ordinance amending Chapters 7.05, 21.03, and 50.06 of the North Liberty Code of Ordinances by amending sections pertaining to the City Administrator. The vote was: ayes – Hoffman, Chipman, Wayson, Kuhl, Donahue; nays – none. Motion carried.
Fire Department Ordinance Update. Hoffman moved, Donahue seconded to approve the second consideration of Ordinance Number 11-04, An Ordinance amending the Code of Ordinances of the City of North Liberty, Iowa, 2010, by amending provisions pertaining to the Fire Department. The vote was: ayes – Wayson, Donahue, Chipman, Kuhl, Hoffman; nays – none. Motion carried.
Zoning Ordinance Update. Chipman moved, Wayson seconded to approve the second Consideration of Ordinance Number 11-05, An Ordinance amending the Zoning Code and Subdivision Regulations of the North Liberty Code of Ordinances by amending Sections 165.09, 170.02, 173.09, and 180.09(2) concerning Good Neighbor Meetings, Residential Day Care Facilities and Signs in Industrial Districts. The vote was: ayes – Kuhl, Donahue, Hoffman, Chipman, Wayson; nays – none. Motion carried.
Old Business. No Old Business was brought forward.
New Business. Councilor Kuhl attended the MPO of Johnson County’s meeting to discuss Transportation Long Range Planning. Councilor Kuhl selected North Liberty projects for the upcoming plan.
Adjournment. At 7:45 p.m., Donahue moved, Kuhl seconded to waive item number 21, Closed Session relating to Litigation and adjourn. All ayes. Meeting adjourned.
