October 24, 2017
Call to order
Mayor Terry Donahue called the October 24, 2017 Regular Session of the North Liberty City Council to order at 6:30 p.m. Councilors present: Chris Hoffman, Sarah Madsen, Annie Pollock, Jim Sayre and Brian Wayson.
Others present: Tracey Mulcahey, Scott Peterson, Kevin Trom, Dean Wheatley, Derek Blackman, Amber Scroggie and other interested parties.
Approval of the Agenda
Madsen moved, Pollock seconded to approve the agenda. After discussion, the vote was all ayes. Agenda approved.
Hoffman moved, Madsen seconded to approve the Consent Agenda including City Council Minutes from the Regular Session on October 10, 2017; the attached list of Claims; September Revenues; September Treasurer’s Report; the Liquor License Renewal for J&A Tap, Class C Liquor License with Catering Privilege and outdoor service and Sunday sales privileges; the Liquor License Renewal for Fareway Stores, Class E Liquor License with Class B Wine Permit and Class C Beer Permit privileges; the Liquor License Application for Rusciano’s Authentic Taste of Napoli, Special Class C Liquor License (Beer/Wine) with Sunday sales privilege; the Liquor License Application for Fiesta Mexican Restaurant, Class C Liquor License with Sunday Sales privilege; the Liquor License Application for Liberty View Wine & Spirits, Class E Liquor License with Sunday sales, Class B Wine Permit and Class C Beer Permit (carryout beer) privileges; the Liquor License Application, Jimmy Jacks Rib Shack, Special Class C Liquor License (Beer/Wine) with Sunday sales and outdoor service privileges; and Pay Application Number 9 for the Phase I – Water System Improvements Division III – Well Construction and Rehabilitation to Gingerich Well & Pump Service in the amount of $128,157.85. After discussion, the vote was all ayes. Consent Agenda approved.
Amber Scroggie, 687 Molly Drive, expressed concerns for handicapped accessibility, lack of availability of Section 8 voucher eligible properties and other concerns.
City Planner Report
City Planner Dean Wheatley reported on rezoning of school property. Wheatley addressed ADA accessibility concerns. All site plans meet ADA requirements. Council discussed the report with Wheatley.
City Engineer Report
City Engineer Kevin Trom reported on projects. The Forevergreen Road from Covered Bridge Boulevard to Jones Boulevard Project, IDOT is beginning ROW acquisition. The project will be bid in September 2018. The contractor on the Water Plant project is making good progress. It is projected to be complete in early Spring. The raw water main project has started. Estimated completion in January. The final check plans for Highway 965 (Ranshaw Way), Phase 3 are with IDOT. The project will be bid in February through IDOT. North Liberty Road is open to traffic. The contractor has completed most of the punch list. The Penn Street project is complete other than the IDOT audit. Site work is almost complete on the Water Storage/Brine/Maintenance Facility. The Trail Network Updates Project plans are 75% complete. The preliminary plans for Front Street from Zeller Street to Cherry Street have been reviewed. The project will be bid in February and starting in spring 2018. The Kansas Avenue RISE Project site survey is almost complete. The project will be bid in April. Council discussed the report with Trom.
City Attorney Report
City Attorney Scott Peterson reported that the requests for acquisitions and easements are plentiful. Peterson updated on easements on the agenda and those that are still outstanding. A special meeting may be necessary to complete the easements and acquisitions. Council discussed the report with Peterson.
Assistant City Administrator Report
Assistant City Administrator Tracey Mulcahey reported on the vacancy on Park and Rec Commission, and North Liberty Business Boom on Thursday, November 2 from 5 – 6:30 at Southslope. Council discussed the report with Mulcahey.
Mayor Donahue proclaimed October as Domestic Violence Awareness Month. DVIP Proclamation. Elias Ortiz was present on behalf of DVIP and accepted the proclamation from the Mayor. Mayor Donahue reported that the League of Women Voter’s candidate forum is tomorrow night.
Highway 965, Phase 3
Peterson provided information on the easements. Council discussed with Peterson. Hoffman moved, Wayson seconded to approve Resolution Number 2017-116, A Resolution rescinding part of Resolution Number 2017-113 regarding Temporary Construction Easement and Public Easement Agreements for the Highway 965 (Ranshaw Way), Phase 3 Improvement Project between North Liberty Medical Building Partnership, L.C. and the City of North Liberty, Johnson County, Iowa. The vote was: ayes – Pollock, Madsen, Hoffman, Sayre, Wayson; nays – none. Motion carried.
Sayre moved, Pollock seconded to approve Resolution Number 2017-117, A Resolution approving the Temporary Construction Easement Agreements and Public Easement Agreements for the Highway 965 (Ranshaw Way), Phase 3 Improvement Project between numerous property owners and the City of North Liberty, Johnson County, Iowa. The vote was: ayes – Sayre, Hoffman, Wayson, Madsen, Pollock; nays – none. Motion carried.
Fats, Oil and Grease Fees
Madsen moved, Hoffman seconded to approve Resolution Number 2017-118, A Resolution establishing Fats, Oil and Grease Manifest and Maintenance Record Fees. The vote was: ayes – Wayson, Pollock, Sayre, Madsen, Hoffman; nays – none. Motion carried.
SRF Interest Rate Adjustment
Madsen moved, Pollock seconded to approve Resolution Number 2017-119, A Resolution providing for the reduction of interest rate for Sewer Revenue Bond. The vote was: ayes – Hoffman, Madsen, Wayson, Sayre, Pollock; nays -none. Motion carried.
Police Officer Position
Chief Diane Venenga presented information regarding hiring a replacement police officer. Council discussed the request with Chief. Hoffman moved, Sayre seconded to authorize the hiring of a new officer. The vote was all ayes. Motion carried.
Peterson presented information regarding this agenda item. At 7:09 p.m., Mayor Donahue opened the Public Hearing regarding disposal of property to right of way. No oral or written comments were received. The public hearing was closed.
Hoffman moved, Sayre seconded to approve Resolution Number 2017-120, A Resolution approving the Warranty Deed from the City of North Liberty for the establishment of right of way. The vote was: ayes- Hoffman, Pollock, Madsen, Sayre, Wayson; nays – none. Motion carried.
Hoffman moved, Wayson seconded to approve Resolution Number 2017-121, A Resolution approving the Public Utility Easement Agreement for the City of North Liberty, Johnson County, Iowa. The vote was: ayes – Pollock, Sayre, Wayson, Madsen, Hoffman; nays – none. Motion carried.
Councilor Hoffman reported that he is a part of the naming committee for the new elementary school. Councilor Pollock reported that she attended the Johnson County Livable Community Policy Board.
Councilor Pollock reported on Haunted Happenings, Trunk or Treat and Trick or Treat in North Liberty. Councilor Wayson reminded all about the Stone Soup Supper. He offered congratulations to UICCU for being named the best financial institution in Iowa. Wayson attended the Library Board meeting. Councilor Madsen reminded all that the City election is November 7.
Mayor Donahue adjourned the meeting at 7:14 p.m.
