North Liberty City Council
April 9, 2013
Regular Session

Call to order
At 6:30 p.m., Mayor Salm called the April 9, 2013 Regular Session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Kuhl, Wayson; absent – Hoffman

Others present: Ryan Heiar, Tracey Mulcahey, Scott Peterson, Kevin Trom, Dean Wheatley, Erika Harper and other interested parties.

Approval of the Agenda
Kuhl moved, Chipman seconded to approve the agenda. The vote was: ayes – Donahue, Wayson, Kuhl, Chipman; nays – none; absent – Hoffman. Motion carried.

Consent Agenda
Donahue moved, Wayson seconded to approve the Consent Agenda including City Council Minutes from the Regular Session on March 26, 2013, the attached list of Claims, Liquor License Application for Yang Chow Wok, Special Class C Liquor License (BW) (Beer/Wine) with Sunday Sales endorsement; Liquor License Renewal for Charlottes, Class C Liquor License with catering privilege and Outdoor Service and Sunday Sales endorsements; Change Order Number 4 for the Streets Maintenance Facility to Garling Construction in the amount of $1,623.00; Pay Request Number 9 for the Library Expansion Project to Todd Hackett Construction in the amount of $225,803.37; and Change Order Number 9 for the Highway 965, Phase 1 Project to Metro Pavers, Inc. in a deduction of $17,212.91. The vote was: ayes – Wayson, Kuhl, Chipman, Donahue; nays – none; absent – Hoffman. Motion carried.

Public Comment
No public comment was offered.

City Engineer Report
City Engineer Trom reported that all the easements, but one for Jones Boulevard, Phase 2 are complete. The preconstruction meeting was held for the West Side Park Project. The weather has not allowed it to get off to a good start.

City Attorney Report
City Attorney Peterson reported that he has a substitute resolution for 13-36 with additional necessary language. He was invited by Interim Chief Venenga to present at a conference on April 26 on Police liability issues.

City Administrator Report
City Administrator Heiar reported that there were about 75 attendees at the project open house meeting. The concerns that were raised on the projects will be addressed by staff. Saturday, April 27 is City Clean Up Day from 7:30 – 11:00 a.m. May 5 is the 100 Tree Planting event for the Centennial. North Liberty is the first city in Iowa to receive the full $10,000 grant for non-disaster related activities. Several staff people met with the HBA to talk about erosion control. Staff has fielded requests for backyard chickens. Heiar asked Council for feedback regarding this item. The requestors will be invited to an upcoming Council meeting to discuss. The preconstruction meeting for the Pheasant Lane Project was held. The project will start construction next week. Over 250 Hairball tickets have been sold. More than 150 rain barrels and 40 composters have been sold.

Mayor Report
Mayor Salm proclaimed April 6 as Mayors Day of Recognition for National Service. Mike Quinlan, Alicia Case, Brandy Smith and Jackie Brennan spoke regarding the amount of volunteerism that occurs in North Liberty. Council thanked for the list that was provided.

Community Addition, Lot 1 Rezoning
Donahue moved, Chipman seconded to approve the second consideration of Ordinance Number 13-04, An Ordinance amending Chapter 167 of the North Liberty Code of Ordinances by amending the use regulations on property owned by University of Iowa Community Credit Union located in North Liberty, Iowa to those set forth in the Municipal Code for the C-2-A Highway Commercial District. The vote was: ayes – Chipman, Donahue, Wayson; nays – Kuhl; absent – Hoffman. Motion carried.

West Village Part 3 Rezoning
Wayson moved, Chipman seconded to approve the second consideration of Ordinance Number 13-05, An Ordinance amending Chapter 167 of the North Liberty Code of Ordinances by amending the use regulations on property owned by Robson Homes located in North Liberty, Iowa to those set forth in the Municipal Code for the RD-10 Duplex Residential District. The vote was: ayes –Chipman, Donahue, Wayson; nays – Kuhl; absent – Hoffman. Motion carried.

Council Meeting Time
Chipman moved, Wayson seconded to approve Resolution Number 13-34, A Resolution approving the time and place of the regular meetings of the North Liberty City Council. The vote was: ayes – Chipman, Donahue, Wayson, Kuhl; nays – none; absent – Hoffman. Motion carried.

Jones Boulevard, Phase 2 Improvement Project
At 6:53 p.m., Mayor Salm opened the Public Hearing on plans, specifications, form of contract and estimate of costs for the Jones Boulevard, Phase 2 Project. No oral or written comments were received. The public hearing was closed.

Donahue moved, Kuhl seconded to approve Resolution Number 13-35, A Resolution approving the plans, specifications, form of contract and estimate of costs for the Jones Boulevard, Phase 2 Improvement Project. After discussion, the vote was: ayes – Donahue, Wayson, Kuhl, Chipman; nays – none; absent – Hoffman. Motion carried.

Kuhl moved, Wayson seconded to approve Resolution Number 13-36, A Resolution approving the Temporary Construction Easement Agreements and Public Easement Agreements for the Jones Boulevard, Phase 2 Improvement Project between numerous property owners and the City of North Liberty, Johnson County, Iowa. After discussion, the vote was: ayes – Wayson, Kuhl, Chipman, Donahue; nays – none; absent – Hoffman. Motion carried.

Design Dental
At 6:57 p.m., Mayor Salm opened the Public Hearing regarding the vacation of an easement. No oral or written comments were received. The public hearing was closed.

Wayson moved, Kuhl seconded to approve Resolution Number 13-37, A Resolution approving the disposal of an easement by the City of North Liberty. After discussion, the vote was: ayes- Kuhl, Chipman, Donahue, Wayson; nays – none; absent – Hoffman. Motion carried.

Wheatley reported that staff and the Planning Commission recommended approval of the site plan application.

Wayson moved, Chipman seconded to approve Resolution Number 13-38, A Resolution approving the Storm Water Management Facility Maintenance Agreement and Easement between the City of North Liberty and Wood and Earth, L.L.C. that establishes the terms and conditions under which storm water management facilities will be maintained for Design Dental in the City of North Liberty, Iowa. After discussion, the vote was: ayes –Chipman, Donahue, Wayson, Kuhl; nays – none; absent – Hoffman. Motion carried.

Kuhl moved, Wayson seconded to approve Resolution Number 13-39, A Resolution approving the Commercial Development Site Plan for Design Dental, North Liberty, Iowa. After discussion, the vote was: ayes – Chipman, Donahue, Wayson, Kuhl; nays – none; absent – Hoffman. Motion carried.

Library Furniture Agreements
Kuhl moved, Wayson seconded to approve Resolution Number 13-40, A Resolution authorizing the execution of the Standard Form of Agreement between the Owner and Contractor for the Library Expansion Furniture Project. After discussion, the vote was: ayes – Donahue, Wayson, Kuhl, Chipman; nays – none; absent – Hoffman. Motion carried.

West Side Park Agreement
Chipman moved, Donahue seconded to approve Resolution Number 13-41, A Resolution authorizing the execution of the Standard Form of Agreement between the Owner and Contractor for the New City Park, Phase 1 Project. The vote was: ayes – Wayson, Kuhl, Chipman, Donahue; nays – none; absent – Hoffman. Motion carried.

South Slope Tower Subtenant Approval
Donahue moved, Wayson seconded to approve Resolution Number 13-42, A Resolution establishing the standards and authority to approve Tower Subtenants. After discussion, the vote was: ayes – Kuhl, Chipman, Donahue, Wayson; nays – none; absent – Hoffman. Motion carried.

Old Business
Councilor Chipman complimented staff on their reports in the Council packet. Councilor Kuhl complimented Bergus on his monthly report format. Kuhl asked about the April 29 Joint Meeting.

New Business
Councilor Donahue updated Council on the North Liberty’s Got Talent Youth Showcase. He thanked volunteers and participants. Councilor Kuhl thanked Councilor Donahue for taking the lead on the event. Volunteers are still being sought for planning committees for upcoming Centennial activities.

At 7:16 p.m., Kuhl moved, Wayson seconded to adjourn. All ayes. Meeting adjourned.

Approval of the Agenda
Chipman moved, Hoffman seconded to approve the agenda. The vote was: ayes – Donahue, Kuhl, Wayson, Hoffman, Chipman; nays – none. Motion carried.

Consent Agenda

City Attorney Peterson had no report.

City Administrator Report
City Administrator Heiar reported that the front entrance to the Community Center reopened today. The Library Expansion is on schedule to move into the new section by the end of April. A project open house meeting is scheduled for March 27 from 5:30 – 7:30 p.m. at the Community Center. The Chamber Legislative Breakfast is scheduled for Saturday, March 30 at 8 a.m. at the Chamber office. The Joint Forevergreen Road Meeting is scheduled for April 2 at 6:30 p.m. at Van Allen Elementary. The Mayor and City Administrator will be on the Legislative Trip to Washington DC, April 16-18.

Mayor Report
Mayor Salm asked Council to discuss revising the start time for meetings and the date for a joint meeting with the County Supervisors. Councilor Hoffman requested moving the start time for Council meetings to 7 p.m. for the months of May and June. The consensus was to do so. The joint meeting with the Johnson County Supervisors will be scheduled for May 28. The meeting will begin at 7 p.m. with the Supervisors with the regular meeting after.

Upcoming Projects Presentation
Kevin Bailey, McClure Engineering, presented the upcoming improvements for Pheasant Lane, Highway 965, Part 2 and Highway 965, Part 2A.

Kevin Trom presented the upcoming improvements to Jones Boulevard, Phase 2.

Multifamily Zoning Ordinance
Donahue moved, Hoffman seconded to approve the third consideration and adoption of Ordinance Number 13-03, An Ordinance amending Chapter 168 of the North Liberty Code of Ordinances by amending Section 168.04 to create new Multifamily Residence Districts. The vote was: ayes – Hoffman, Chipman, Wayson, Donahue, Kuhl; nays – none. Motion carried.

Community Addition, Lot 1 Rezoning
At 7:30 p.m., Mayor Salm opened the public hearing. No oral or written comments were received. The public hearing was closed.

Wheatley reported that the application was recommended for approval by Planning Commission and that no one attended the Good Neighbor meeting.

Donahue moved, Chipman seconded to approve the first consideration of Ordinance Number 13-04, An Ordinance amending Chapter 167 of the North Liberty Code of Ordinances by amending the use regulations on property owned by the University of Iowa Community Credit Union located in North Liberty, Iowa to those set forth in the in the Municipal Code for the C-2-A Highway Commercial District. After discussion, the vote was: ayes – Wayson, Chipman, Donahue, Hoffman; nays – Kuhl. Motion carried.

West Village Part 3 Rezoning
At 7:34 p.m., Mayor Salm opened the public hearing. No oral or written comments were received. The public hearing was closed.

Wheatley reported that the Planning Commission recommended approval and that one person attended the Good Neighbor meeting. Council discussed the application.

Mike Bails spoke on behalf of the applicant.

Chipman moved, Donahue seconded to approve the first consideration of Ordinance Number 13-05, An Ordinance amending Chapter 167 of the North Liberty Code of Ordinances by amending the use regulations on property owned by Robson Homes located in North Liberty, Iowa to those set forth in the Municipal Code for the RD-10 Duplex Residential District. The vote was: ayes – Chipman, Hoffman, Donahue, Wayson; nays – Kuhl. Motion carried.

Hoffman moved, Wayson seconded to approve Resolution Number 13-30, A Resolution approving the Preliminary Plat for West Village, Part 3, North Liberty, Iowa. The vote was: ayes – Donahue, Wayson, Hoffman, Kuhl, Chipman; nays – none. Motion carried.

South Slope Tower
Kuhl moved, Donahue seconded to approve Resolution Number 13-31, A Resolution approving tower lease and addendum between the City of North Liberty and South Slope Communications for communications tower on City property. After discussion, the vote was: ayes – Hoffman, Chipman, Kuhl, Wayson, Donahue; nays – none. Motion carried.

Quail Ridge Park
Kuhl moved, Hoffman seconded to approve moving forward with the Quail Ridge Playground Project estimated at $80,000. The vote was: ayes – Kuhl, Chipman, Wayson, Donahue, Hoffman; nays – none. Motion carried.

Kuhl moved, Hoffman seconded to approve the ball field improvements at Quail Ridge Park estimated at $20 – 25,000. After discussion, the vote was: ayes – Chipman, Hoffman, Wayson, Donahue, Kuhl; nays – none. Motion carried.

West Side Park Project
Hoffman moved, Wayson seconded to approve Resolution Number 13-32, A Resolution accepting the bid for the West Side Park Project, Phase 1, North Liberty, Iowa. After discussion, the vote was: ayes- Wayson, Donahue, Hoffman, Chipman, Kuhl; nays – none. Motion carried.

Biennial Bridge Inspections
Hoffman moved, Kuhl seconded to approve Resolution Number 13-33, A Resolution approving the Professional Services Agreement for services relating to Biennial Bridge Inspections between the City of North Liberty, Iowa and VJ Engineering, Inc. After discussion, the vote was: ayes – Chipman, Hoffman, Kuhl, Donahue, Wayson; nays – none. Motion carried.

Councilor Kuhl reported on the ICAD labor shed luncheon. He requested a work session on the topic.

Council Kuhl reported that MPOJC will meet tomorrow at 4:30 p.m. in Coralville.

Councilor Hoffman reported on the school district facility committee’s progress.

New Business
Councilor Donahue reported on April 6 at 2 p.m. at Grace Community Church, the Centennial Committee will be hosting North Liberty’s Got Talent.

Regular Session

Call to order
At 6:30 p.m., Mayor Salm called the March 12, 2013 Regular Session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Hoffman, Kuhl, Wayson.

Others present: Ryan Heiar, Tracey Mulcahey, Scott Peterson, Kevin Trom, Erika Harper, Tina Dubois, Brandy Smith and other interested parties.

Approval of the Agenda
Chipman moved, Hoffman seconded to approve the agenda. The vote was: ayes – Hoffman, Wayson, Kuhl, Donahue, Chipman; nays – none. Motion carried.

Consent Agenda
Hoffman moved, Wayson seconded to approve the Consent Agenda including City Council Minutes from the Regular Session on February 26, 2013; the attached list of Claims; the Liquor License Renewal for Azul Tequila, Class C Liquor License with Sunday Sales endorsement; Pay Application Number 7 for the Library Expansion Project to Todd Hackett Construction in the amount of $145,264.73 and Pay Application Number 8 for the Library Expansion Project to Todd Hackett Construction in the amount of $503,653.14. Public Comment
Tina Dubois & Brandy Smith from the North Liberty Community Pantry spoke about National Americorps Week. They thanked council for the support of new pantry and the Each One Reach One – Americorps Program.

City Engineer Report
City Engineer Kevin Trom reported on the Forevergreen Road alignment project. North Liberty staff has met with MPO and Johnson County staff. The proposed project will be presented to the Johnson County Supervisors on March 28 at their informal meeting. The joint Council worksession will be held on April 2 at Van Allen Elementary at 6:30 p.m.

Trom reported on the progress on the Jones Boulevard Improvements Project, Part 2. Staff is getting close on easements. Staff will be hosting meetings with directly affected property owners. The public hearing is scheduled for April 9. Bids will be received on April 15 and awarded at the April 23 meeting.

Trom attended the Iowa Water Conference. He attended an urban storm water quality projects presentation.

Trom reported that the Mehaffey Bridge Road project will begin design in mid-May. The project is scheduled for construction next year.

The west side park public hearing is tonight.

Councilor Wayson asked about the impact of the Jones Boulevard Project on the water levels on the south end of Jones. Trom reported that utilities will be the first line item constructed and should improve the water issues.

City Attorney Report
City Attorney Peterson offered to answer questions.

City Administrator Report
City Administrator Heiar reported on the progress of the Library Project. The front entrance has been a point of contention. By the end of next week, the front entrance should be open. The project is still on schedule to move the library into the new section in early May.

Heiar reported on the impact of the federal sequester on North Liberty. There is no direct impact, but city residents may be impacted through their employment, education and other federal programs.

Heiar reminded Council of upcoming important dates, Joint Work Session with Coralville – April 2, 6:30 p.m., the project open house on March 27 from 5:30 p.m. – 7:30 p.m. City staff will be hosting a Press Conference on Thursday at 10 a.m. at the UICCU branch in North Liberty to unveil information about the North Liberty Birthday Bash scheduled for July 13.

Mayor Report
Mayor Salm read a statement regarding the incident on Sunday, March 10, 2013.

Multifamily Zoning Ordinance
Donahue moved, Hoffman seconded to approve the second consideration of Ordinance Number 13-03, An Ordinance amending Chapter 168 of the North Liberty Code of Ordinances by amending Section 168.04 to create new Multifamily Residence Districts. The vote was: ayes – Kuhl, Donahue, Chipman, Hoffman, Wayson; nays – none. Motion carried.

Sewer Upgrades Improvement Project.
Donahue moved, Chipman seconded to approve Resolution Number 13-24, A Resolution approving the Services Agreement between the City of North Liberty, Iowa and Shive-Hattery, Inc. for services relating to the Sewer Upgrades Improvement Project, North Liberty, Iowa and financing of certain proposed project to be undertaken by the City of North Liberty, Iowa; establishing compliance with the Reimbursement Bond Regulations under the Internal Revenue Code. After discussion, the vote was: ayes – Donahue, Chipman, Hoffman, Wayson, Kuhl; nays – none. Motion carried.

Library Furniture Bids
Hoffman moved, Wayson seconded to approve Resolution Number 13-25, A Resolution accepting the bids for the Library Furniture Project, North Liberty, Iowa. After discussion, the vote was: ayes – Chipman, Hoffman, Wayson, Kuhl, Donahue; nays – none. Motion carried.

Front Street Annexation
At 6:53 p.m., Mayor Salm opened the public hearing regarding proposed application for voluntary annexation. No oral or written comments were received. The public hearing was closed.

Kuhl moved, Wayson seconded to approve Resolution Number 13-26, A Resolution authorizing and accepting the application for voluntary annexation of property located at 2574 Mehaffey Bridge Road to the City of North Liberty, Iowa. After discussion, the vote was: ayes – Hoffman, Wayson, Kuhl, Donahue, Chipman; nays – none. Motion carried.

West Side Park Project
At 6:54 p.m., Mayor Salm opened the public hearing regarding plans, specifications, form of contract and estimate of cost. No oral or written comments were received. The public hearing was closed.

Donahue moved, Chipman seconded to approve Resolution Number 13-27, A Resolution approving plans, specifications, form of contract and estimate of cost for the West Side Park Improvements Project, Phase 1. After discussion, the vote was: ayes – Wayson, Kuhl, Donahue, Chipman, Hoffman; nays –none. Motion carried.

Telecommunications Commission Appointments
Kuhl moved, Wayson seconded to appoint Ryan Griffin and Bryon Gattas to the Telecommunications Commission. The vote was: ayes – Kuhl, Donahue, Chipman, Hoffman, Wayson; nays – none. Motion carried.

Snow removal Assessment
Hoffman moved, Wayson seconded to approve Resolution Number 13-28, A Resolution authorizing the Assessment of Delinquent amounts owed to the City of North Liberty, Iowa, to individual property taxes. The vote was: ayes – Donahue, Chipman, Hoffman, Wayson, Kuhl; nays – none. Motion carried.

NLYBS Agreement
Hoffman moved, Kuhl seconded to approve Resolution Number 13-28, A Resolution approving the Agreement for Baseball and Softball Leagues between the City of North Liberty and North Liberty Youth Baseball/Softball. After discussion, Hoffman moved, Wayson seconded to amend the resolution to include “WHEREAS, it is the parties’ desire to emphasize that the NLYBS program is based on a joint effort of both parties, who share significant resources to support the program”. The vote on the amendment was: ayes- Chipman, Hoffman, Wayson, Kuhl, Donahue; nays – none. Motion carried. The vote on the resolution was: ayes – Hoffman, Wayson, Kuhl, Donahue, Chipman; nays – none. Motion carried.

Regular Session

Call to order.
At 6:30 p.m., Mayor Salm called the February 26, 2013 Regular Session of the North Liberty City Council to order. Council members present: Chipman, Donahue, Hoffman, Kuhl, Wayson.

Others present: Ryan Heiar, Dean Wheatley, Kevin Trom, Erika Harper, Scott Peterson, Kevin Bailey, Mary Byers, Lori Lindner and other interested citizens.

Approval of the Agenda.
Chipman moved, seconded by Hoffman, to approve the agenda of February 26, 2013. The vote was: ayes—Hoffman, Donahue, Wayson, Chipman, Kuhl. Motion carried.

Consent Agenda.
Donahue moved, seconded by Hoffman to approve the Consent Agenda including the City Council Minutes of February 12, 2013, Claims, and January Revenues, and subject to amending the City Council Minutes of February 12, 2013 to reflect the correct vote on the Linn County REC item. The vote was: ayes—Donahue, Chipman, Kuhl, Wayson, Hoffman. Motion carried.

Public Comment.

City Engineer Report.
Trom had no report.

City Attorney Report.
Staff has been re-writing the Subdivision Ordinance and will soon be ready for review by the City Council and Planning commission.

City Administrator Report.
There will be a joint meeting with the Coralville and North Liberty City Councils to review the Forevergreen Road Study on April 2nd at 6:30 p.m. at Van Allen Elementary School.

The west side park plans will soon be completed and the Public Hearing will be set at the first City Council meeting in March.

Heiar reported that staff had three good interviews for the Telecommunications Director and will have a decision next week.

Heiar reported that he spent the day in Des Moines for the Annual Corridor Day. The topics discussed were education reform, property taxes, railroad initiative and economic development. The group was able to meet with the house and senate leaders and Heiar felt it was informative.

Mayor Report.
The Mayor will be attending the Johnson County Board of Supervisors meeting Wednesday night with Mayor Fausett of Coralville and Mayor Hayek of Iowa City. The county is having a Public Hearing on their Budget and will be talking about the Seats Program.

Hoffman reported on the first of five open meetings that the Iowa City School District is having on the needs assessment of their buildings. The architect firm BLDD from Aurora, Illinois is leading the study. The next meeting is March 11 at 5:00 p.m. Meetings are open to the public and also will be televised and replayed on Public Access.

FY 14 Budget.
At 6:50 p.m. Mayor Salm opened the public hearing regarding proposed FY 14 Budget and CIP. No oral or written comments were received. The public hearing was closed.

Donahue moved, seconded by Hoffman, to approve Resolution Number 13-17, A Resolution adopting the Annual Budget and Capital Improvements Plan for the Fiscal Year ending June 30, 2014 for the City of North Liberty, Iowa. After discussion, the vote was: ayes—Wayson, Kuhl, Chipman, Donahue, Hoffman; nays—none. Motion carried.

Highway 965 Agreements.
Kevin Bailey of McClure Engineering addressed questions from the council on the Highway 965 Improvements. Heiar said that open houses will be held for the projects so the public can come and view maps and get more details.

Donahue moved, seconded by Hoffman, to approve Resolution Number 13-18, A Resolution approving the Federal Aid Agreement between the City of North Liberty and the Iowa Department of Transportation for Project Number STP-U-5557 (617)—70-52; Iowa DOT Agreement Number 6-12-STPU-35 for the Highway 965, Phase 2 Project. After discussion, the vote was: ayes—Hoffman, Donahue, Chipman, Wayson, Kuhl; nays—none. Motion carried.

Kuhl moved, seconded by Wayson, to approve Resolution Number 13-19, A Resolution approving an Agreement for Engineering Services between the City of North Liberty and McClure Engineering Company for services relating to the Highway 965 Improvements Project, Phase 2, North Liberty, Iowa. After discussion, the vote was: ayes—Donahue, Kuhl, Chipman, Hoffman, Wayson; nays—none. Motion carried.

Chipman moved, seconded by Kuhl, to approve Resolution Number 13-20, A Resolution approving an Agreement for Engineering Services between the City of North Liberty and McClure Engineering Company for services relating to the Highway 965 Improvements Project, Phase 2, North Liberty, Iowa. After discussion, the vote was: ayes—Chipman, Hoffman, Donahue, Wayson, Kuhl; nays—none. Motion carried.

Multifamily Zoning Ordinance.
At 7:10 p.m. Mayor Salm opened the public hearing regarding the first consideration of Ordinance Number 13-03 amending Section 168.04 to create a new Multifamily Residence Districts. No oral or written comments were received. The public hearing was closed.

Wheatley reported that these two new multifamily zoning districts are less dense than the current multifamily districts, and are equivalent to the RS-4 and RS-6 Single-family Districts in square footage.

Donahue moved, seconded by Kuhl, to approve the first consideration of Ordinance Number 13-03, An Ordinance amending Section 168.04 to create new Multifamily Residence Districts. After discussion, the vote was: ayes—Wayson, Chipman, Kuhl, Donahue, Hoffman; nays—none. Motion carried.

Liquor License Application.
Heiar explained that Liquor License Applications are usually a part of the Consent Agenda, but when doing the required background check, one of the co-owners of Los Jimadores had misdemeanors on his record. Staff recommends approval with the condition that the state takes a closer look at this application prior to their approval and that the city review the business in six months.

Wayson moved, seconded by Hoffman, to approve the liquor license for Los Jimadores, subject to reviewing the license in six months. After discussion, the vote was: ayes—Donahue, Wayson, Hoffman, Chipman; nays—Kuhl. Motion carried.

Cedar Rapids Range Usage.
Chipman moved, seconded by Donahue, to approve Resolution Number 13-21, A Resolution approving the Memorandum of Agreement between the City of North Liberty and the City of Cedar Rapids, Iowa for the access and use of the Cedar Rapids Police Department Shooting Range. After discussion, the vote was: ayes—Hoffman, Donahue, Kuhl, Chipman, Wayson; nays—none. Motion carried.

Pagliai Subdivision.
This is a one lot subdivision located over a mile away from North Liberty on Scales Bend Road. State Code requires a resolution from Council if extraterritorial plat review is waived.
Chipman moved, seconded by Wayson, to approve Resolution Number 13-22, A Resolution waiving the right to review the Pagliai-Looney Tunes Subdivision, Johnson County, Iowa. After discussion, the vote was: ayes—Donahue, Kuhl, Wayson, Hoffman, Chipman.

FY 12 Audit Report.
Chipman moved, seconded by Hoffman, to approve Resolution Number 13-23, A Resolution accepting the Audit Report for Fiscal Year 2012 as completed by Greenwood and Crim, P.C. After discussion, the vote was: ayes—Wayson, Chipman, Kuhl, Donahue, Hoffman; nays—none. Motion carried.
