Regular Session
Call to order
Mayor Chris Hoffman called the April 26, 2022 Regular Session of the North Liberty City Council to order at 6:30 p.m. Councilors present: Ashley Bermel, Erek Sittig, Brent Smith, Brian Wayson; absent – RaQuishia Harrington.
Others present: Ryan Heiar, Stacey House, Ryan Rusnak, Kevin Trom, Grant Lientz, and other interested parties.
Closed Session
At 6:33 p.m., Wayson moved, Sittig seconded to enter into closed session according to Iowa Code Section 21.5(1) (c) to discussion strategy with counsel in matter that are presently in litigation of where litigation is imminent where it’s disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation. The vote was: ayes – Bermel, Sittig, Smith, Wayson; nays – none. Motion carried.
At 6:50 p.m., Bermel moved, Wayson seconded to return to open session. The vote was: ayes – Sittig, Wayson, Bermel, Smith; nays – none. Motion carried.
Approval of the Agenda
Sittig moved; Wayson seconded to approve the agenda. The vote was all ayes. Agenda approved.
Consent Agenda
Sittig moved, Wayson seconded to approve the Consent Agenda including the City Council Minutes from the Regular Session on April 12, 2022; the attached list of Claims; March Revenues; Dubuque Street Phase 1 Project; All American Concrete, Pay Application Number 1, $120,576.47; Ranshaw Way Phase 5 Improvements, Peterson Contractors, Inc., Pay Application Number 12, $132,457.16. The vote was all ayes. Consent Agenda approved.
Public Comment

City Engineer Report
City Engineer Trom reported that the contractor on the Ranshaw Way Phase 5 project is working on the paving of the corners, installation of the retaining wall near the tunnel, placing the brick pavers in the medians, installing electrical conduits and grading for the upcoming trail and sidewalk. The Centennial Park loop road contractor completed final site grading and seeding last week. The only thing left is the painting of the stalls and placement of the amended soils and plants. Completion date is May 6th, and the contractor is aware. Dubuque Street Phase 1 project is progressing with work. The Jones Boulevard extension project and The Community Center Roof Project are on the agenda tonight. The Community Center Facility Plan will be submitted to City staff for review on Thursday.
City Administrator Report
City Administrator Heiar reminded Council the county brought up a topic of the Silurian aquifer study. The board of Supervisors are having a meeting tomorrow. He will have more to report after the meeting. ICAD will be present at next council meeting for an update.
Mayor Report
Hoffman read and presented the Arbor Day Proclamation and the Bike Month Proclamation. The bike ambassador from Iowa City and family thanked all the staff for this proclamation for Bike Month. Mayor Hoffman attended the first ever University of Iowa decarbonation Summit. Had the Joint Entities meeting last Monday, discussed the updates from Johnson County. Iowa Debut of the documentary of Decent Home is Thursday at film scene. Invitation from chief Platz Sunday morning at the fire department. Guide link center invitation is Wednesday May 18th. May 6th is the Iowa City first Friday coffee at 7:30am.
Council Reports
Councilor Wayson volunteered at the CRANDIC run. Councilor Smith attended a fundraiser golf outing for the Skelly family and attended the planning open house. He stopped in at Red’s to touch base about the construction. Councilor Sittig also attended the planning open house, was excited about the younger generation showing up. He also attended the joint entities meeting. He had the honor of attending a dinner with several community leaders. Councilor Bermel reported on an affordable housing meeting she attended (virtually) and the Coralville connections meeting. She is excited about what will come to our community. Councilor Sittig advised that the city does have tickets for the film on Thursday.
Highway 965 Phase 2 Project
Bermel moved, Sittig seconded to approve Resolution Number 2022-38, A Resolution regarding the settlement of legal claim, the vote was: ayes – Smith, Bermel, Sittig, Wayson; nays – none. Motion carried.
Jones Boulevard Extension Project
Smith moved, Sittig seconded to approve Resolution Number 2022-39, A Resolution accepting the Bid and authorizing execution of the Contract for the Jones Boulevard Improvements Project, North Liberty, Iowa. After discussion, the vote was: ayes – Sittig, Bermel, Wayson, Smith; nays – none. Motion carried.
Community Center Roof Replacement
Kevin Trom presented information on the application. Smith moved, Wayson seconded to approve Resolution Number 2022-40, A Resolution accepting the Bid and authorizing execution of the Contract for the Community Center Roof Replacement, North Liberty, Iowa. The vote was: ayes – Bermel, Smith, Sittig, Wayson; nays – none. Motion carried.
Liberty Centre Easement
Bermel moved, Sittig seconded to approve Resolution Number 2022-31, A Resolution vacating an Easement being a part of the Final Plat of Liberty Centre, Part One, North Liberty, Iowa. After discussion, the vote was: ayes – Bermel, Smith, Wayson, Sittig; nays – none. Motion carried.

Bermel moved, Sittig seconded to approve Resolution Number 2022-44, A Resolution approving the Amended and Restated Developer’s Agreement for The Preserve – Part Two A North Liberty, Iowa. After discussion, the vote was: ayes – Smith, Sittig, Bermel, Wayson; nays – none. Motion carried.
Rusnak presented information on the Final Plat. Smith moved, Wayson seconded to approve Resolution Number 2022-45, A Resolution Approving the Final Plat and Accepting Improvements for The Preserve – Part Two A North Liberty, Iowa. After discussion, the vote was: ayes – Smith, Sittig, Wayson, Bermel; nays – none. Motion carried.
Liberty Villas Rezoning
At 7:31 p.m., Mayor Hoffman opened the Public Hearing regarding proposed rezoning amendments. No oral or written comments were received. The public hearing was closed.
Rusnak presented information on the site plan and the staff and Commission recommendations. The Planning Commission recommended approval with no conditions.
Brad Cummins was present and offered to answer questions.

Old Business

New Business
Councilor Smith spoke about being concerned about the railroad cars, and when they would potentially be moved. Heiar stated we don’t have jurisdiction. Councilor Sittig stated he was glad to see that the pumps have been removed from the old Casey’s and asked about a demolition permit. Heiar stated none has been requested at this time.
