Minutes
July 7, 2015
Roll Call
At 6:30 p.m., Vice Chair Jim Sayre called the July 7, 2015 Planning Commission meeting to order. Commission members present: Bleil, Covert, Gebhart, Heisler, Pentecost, Sayre; absent – Detlefsen.
Others present: Dean Wheatley, Ryan Heiar, Tracey Mulcahey, Scott Peterson, Stefan Juran, Duane Musser, Vic Jarbo and other interested parties.
Agenda Approval
Bleil moved, Covert seconded to approve the agenda. The vote was all ayes. Agenda approved.
Public Comment
No comments were offered.
Scanlon Family Farms LLC Rezoning
Staff Presentation
Wheatley presented the request of Scanlon Family Farms LLC to approve a rezoning of property from ID (Interim Development) to RS-4 (Single-Family Residential), for property located directly north of the new Liberty High School, east of North Liberty Road. Staff recommends approval of this rezoning with no conditions.
Applicant’s Presentation
Duane Musser, MMS Consultants, presented additional information regarding the application and offered to answer questions.
Public Comments
No public comments were offered regarding this application.
Questions and Comments of the Commission
The Commission asked about the concept plan, storm water management on the site and impacts on neighboring subdivision and the consistency with land use plan.
Recommendation to the City Council
Heisler moved, Covert seconded to recommend approval of the Scanlon Family Farms LLC Rezoning application to the City Council with no conditions. The vote was: ayes – Bleil, Heisler, Sayre, Gebhart, Pentecost, Covert; nays – none. Motion carried.
Bobby’s Live on 965 Conditional Use Application
Staff Presentation
Wheatley presented the request of Vic Jarbo to approve a conditional use permit for the establishment of a small outdoor eating and drinking patio at Bobby’s Live on 965 Restaurant, located at the northwest corner of Ashley Court and Jordan Street. Staff recommends approval with the following conditions: for this owner only, with alcoholic beverage sales allowed, no amplified music, and no more seats than allowed by the Building and Fire Codes for this location.
Applicant’s Presentation
Vic Jarbo was present and offered additional information on the application. The Commission discussed changing the grass to concrete and previous complaints.

Questions and Comments of the Commission
The Commission had no further questions or discussion on this application.
Recommendation to the Board of Adjustment
Heisler moved, Gebhart seconded to recommend approval of the Conditional Use Application for Bobby’s Live on 965 to the Board of Adjustment with the following conditions: for this owner only, with alcoholic beverage sales allowed, no amplified music, and no more seats than allowed by the Building and Fire Codes for this location. The vote was: ayes – Covert, Bleil, Pentecost, Sayre, Gebhart, Heisler; nays – none. Motion carried.

Staff Presentation

Questions and Comments of the Commission
The Commission discussed the application and the proposed rezoning of city properties and the timing of the rezoning application with the adoption of the updated map.
Recommendation to the City Council
Bleil moved, Covert seconded to recommend approval of the proposed corrections to the City Council. The vote was: ayes – Pentecost, Sayre, Covert, Heisler, Gebhart, Bleil; nays – none. Motion carried.
Approval of Previous Minutes
Gebhart moved, Covert seconded to approve the minutes from the June 2, 2015 Planning Commission meeting. The vote was all ayes. Minutes approved.
Old Business
No old business was presented.
New Business
Wheatley presented the proposed outlot swap in the unplatted Fox Valley Subdivision. The Commission discussed the proposed revised Fox Valley open space.
Wheatley reported that there are one or no cases next month. He might try to schedule a joint meeting with council.

At 7:06 p.m., Gebhart moved, Covert seconded to adjourn. All ayes. Meeting adjourned.
