RFP Overview
NOTICE IS HEREBY GIVEN:
Sealed proposals will be received by the City Clerk, City of North Liberty, Iowa, in her office at the North Liberty Administration Building, 3 Quail Creek Circle, North Liberty, Iowa, until 10:00 AM (local time) on August 16, 2016, for the project described as Phase I Water System Improvements, Division 1 – Water Treatment Plant, City of North Liberty, North Liberty, Iowa, as hereinafter described in general and as described in detail in the Bidding Requirements and Contract Documents for said improvements now on file in the office of the City Clerk. Proposals will be opened and read at the North Liberty Administration Building at 10:00 AM (local time) on August 16, 2016. Proposals will be acted upon by the City Council at a meeting to be held at 6:30 PM on August 23, 2016, in the City Council Chambers, North Liberty, Iowa or at such later time as may be designated at said meeting.
At 6:30 PM (local time) on August 9, 2016 at the regularly scheduled City of North Liberty Council meeting in the City Council Chambers, a hearing will be held on the proposed Bidding Requirements, Contract Documents (drawings and specifications) and Opinion of Probable Construction Cost for said project, and at said hearing any interested person may appear and file objections thereto.
A Pre-Bid Conference shall be held at the City of North Liberty, Iowa at 10:00 AM (local time)on August 2, 2016. The Pre-Bid Conference shall commence at the North Liberty Community Center and shall include visits to the new water treatment plant site and existing and new well sites.
The general extent of the work involved is as follows: Phase I Water System Improvements, Division I – Water Treatment Plant shall include the construction of a new 3.0 MGD Nanofiltration Water Treatment Plant consisting of precast concrete treatment building, chemical storage and handling facilities, high service pumping, ground storage reservoir and installation of nanofiltration equipment previously procured by the city, site piping, site work, electrical and controls systems, new well control building and all miscellaneous associated work.
The method of construction shall be by contract in accordance with the Bidding Requirements and Contract Documents for said improvements approved by the North Liberty City Council.
Each proposal shall be made out on a blank form furnished by the City and shall be submitted in a sealed envelope marked, Phase I Water System Improvements, Division I – Water Treatment Plant, City of North Liberty, North Liberty, Iowa. Each proposal must be accompanied either by a cashier’s check or certified check in the amount of five percent (5%) drawn on an Iowa bank or a bank chartered under the laws of the United States, a Bid Bond or credit union certified share draft in the amount of five percent (5%) of the proposal, drawn on a credit union in Iowa or chartered under the laws of the United States and filed in an envelope separate from the one containing the proposal, made payable to the City of North Liberty, Iowa, and said check or draft may be cashed or the Bid Bond declared forfeited by the City of North Liberty, Iowa as liquidated damages in the event the successful bidder fails to enter into a contract within fifteen (15) days of the Notice of Award and post bond satisfactory to the City insuring the faithful fulfillment of the contract and maintenance of said improvements as required by law and the Specifications.
Payment to the Contractor for said construction will be made in cash from the following sources: Cash from any fund of City of North Liberty, Iowa, which may be legally used for such purposes; proceeds derived from the sale and issuance of Utility Revenue Bonds, or Federal or State grants or loans.
The Contractor will be paid each month Ninety-five Percent (95%) of the Engineer’s Estimate of the value of work completed at the end of the preceding month. Final payment will be made no sooner than thirty (30) days after completion of the work and acceptance by the Owner.
The work under the proposed contract shall commence within thirty (30) days of the written “Notice to Proceed.” The work shall be substantially completed by May 15, 2018, and with final completion by August 15, 2018, subject to any changes granted by the Owner.
By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the State of Iowa, and to Iowa domestic labor.
The Owner reserves the right to reject any or all proposals and to waive informalities.
The successful bidder will be required to furnish a bond in an amount equal to 100% of the contract price, and said bond to be issued by a responsible surety approved by the Owner and shall guarantee the faithful performance of the contract and the terms and conditions therein contained, and the warranty of the materials and workmanship for not less than two (2) years from the time of acceptance of said improvements by the City Council. Out-of-state bidders shall be prepared to submit an Out-of-State Contractor Bond to the Iowa Division of Labor in accordance with Chapter 91C of the Code of Iowa.
Iowa law provides that on public improvements a resident bidder shall be allowed preference as against a nonresident bidder from a state or foreign country which gives or requires a preference to bidders from that state or foreign country. The preference so allowed shall be equivalent to the preference given or required by the state or foreign country in which the nonresident bidder is a resident.
Bidding Requirements and Contract Documents governing the construction of the proposed improvements have been prepared by FOX Engineering Associates, Ames, Iowa, which documents and the proceedings of the City Council referring to and defining said improvements are hereby made a part of this Notice and the proposed contract by reference and the proposed contract shall be executed to comply therewith.
The Owner reserves the right to defer acceptance of any proposal for a period not to exceed forty-five (45) days from the date of receipt of proposals.
Nondiscrimination In Employment: Bidders on this work will be required to comply with the President’s Executive Order No. 11246. Requirements for bidders and contractors under this order are explained in the specifications.
Any bidder or equipment supplier whose firm or affiliate is listed in the General Services Administration (GSA) monthly publication entitled “Lists of Parties Excluded from Federal Procurement or Nonprocurement Programs” will be prohibited from the bidding process. Anyone submitting a bid who is listed will be determined to be a non-responsive bidder. A contractor’s Suspension/Debarment Certification will be contained in the specifications: however, this certification should not preclude any interested party from ascertaining whether the certifying firm or person is actually on the GSA “Lists of Parties Excluded from Federal Procurement or Nonprocurement Programs”. The list will be available for inspection upon request to determine a person’s eligibility for award in accordance with 40 CFR Part 32, dated May 26, 1988.

Copies of said Bidding Requirements and Contract Documents are now on file in the office of the City Clerk, City Hall, North Liberty, Iowa, for examination by prospective bidders. Prospective bidders may obtain copies from FOX Engineering Associates, 414 South 17th Street, Suite 107, Ames, Iowa, 50010. A deposit charge of $250.00 per set of Bidding Requirements and Contract Documents will be made, all of which will be refunded if returned in reusable condition within 14 days of the Award of Contract. If all documents are not returned in reusable condition and within 14 days, the deposit shall be forfeited.
