Judge rules in city's favor on Liberty High School utilities injunction request

To date, 12 property owners have voluntarily agreed to sell underground rights for this critical infrastructure and temporary access to install it.
Today, District Court Judge Christopher L. Bruns issued his 14-page ruling on the request of a 13th and final property owner, Dr. Gary Weinman, for a injunction against condemnation for the sewer easement, concluding:

Dr. Weinman has not identified a single underlying claim on which there is a probability of success.  Consequently, the court need not reach any other issue relevant to grant of a temporary injunction. The request for temporary injunctive relief is denied.

The complete ruling is available here.
We remain open to working towards an agreement with Dr. Weinman, though with the timeline for Liberty High School set by the Iowa City School District, we need to continue to make progress towards infrastructure upgrades. We’ll continue to use the process laid out by the state, which balances the public good with the interests of private land owners, to move forward.
